This webinar will explore recent developments concerning the criminal responsibility of children in Australia, focusing on the presumption of doli incapax (the rebuttable presumption that a child aged 10, but not yet 14, does not have the capacity to be held criminally responsible). It will examine how the presumption of doli incapax, and its statutory equivalents, currently operate and should operate in practice, what sort of factors are used to rebut the presumption, and why the presumption is subject to criticism. This will include reference to the recent Review of the operation of doli incapax in NSW for children under 14 by the Honourable Geoffrey Bellew SC and Jeffrey Loy APM as well as the ensuing Children (Criminal Proceedings) and Young Offenders Legislation Amendment Act 2025 (NSW).
